Acceptable Use Policy

Rules that protect customers, networks, email reputation, and the public from unlawful or abusive use.

1. General rule

This Policy governs services provided by Top-Notch Hosting Services LLC, doing business as Top-Notch Hosting. You may use those services only for lawful purposes and in a way that does not harm people, systems, networks, or our ability to serve other customers. You are responsible for your content, users, applications, mailing practices, and activity conducted through your account.

2. Prohibited activity

You may not use, attempt to use, or allow another person to use a service to:

  • violate a law, court order, sanction, export restriction, or another person’s rights;
  • host, distribute, solicit, or facilitate child sexual abuse material, non-consensual intimate imagery, credible threats, trafficking, or content whose possession or distribution is unlawful;
  • infringe copyright, trademark, privacy, publicity, confidentiality, or other legal rights;
  • create or distribute malware, ransomware, spyware, credential theft, phishing, deceptive impersonation, or fraudulent schemes;
  • probe, scan, exploit, disrupt, overload, or gain unauthorized access to an account, device, network, service, or data;
  • circumvent authentication, rate limits, usage controls, monitoring, security systems, provider restrictions, or suspension;
  • send spam or unsolicited bulk email, use purchased or scraped lists, forge headers, conceal message origin, ignore unsubscribe requests, or generate abusive complaint or bounce rates;
  • operate open relays, malicious redirectors, botnets, denial-of-service systems, cryptomining that materially degrades shared resources, or other resource abuse;
  • resell or share a service in a way not allowed by the plan or place unreasonable load on shared infrastructure; or
  • assist, encourage, or conceal any prohibited conduct.

3. Email requirements

Commercial or bulk email must use permission-based recipients, accurate sender identity, a working unsubscribe method, and all notices required by law. You must promptly honor opt-outs, remove invalid addresses, secure mailboxes and forms against abuse, and maintain acceptable complaint and bounce rates. We may limit or suspend sending to protect deliverability and network reputation.

4. Security and resource use

You must keep software and credentials reasonably secure, investigate compromised accounts, and cooperate with remediation. Resource use must remain within the plan and must not materially impair shared systems. We may require an upgrade, configuration change, traffic reduction, or migration when usage threatens stability.

5. Enforcement

We may investigate suspected violations and remove or restrict content, block traffic, quarantine a service, limit sending, suspend access, or terminate a service when reasonably necessary. We consider severity, recurrence, intent, legal duties, immediate risk, and whether the issue can be safely cured. We may act without advance notice in an emergency or where notice would increase harm.

We may preserve and disclose relevant information when legally required or reasonably necessary to protect rights, safety, or systems. Fees are not automatically refundable when a service is suspended or terminated for violation of this Policy.

6. Reporting abuse

Report suspected abuse through Contact & Support with the affected domain, relevant URLs or message headers, timestamps, and a concise description. Do not send illegal content itself unless specifically requested through a lawful, secure channel.
